BY REGISTERING AND/OR BIDDING, YOU AGREE TO THE FOLLOWING CONDITIONS OF SALE:

  1. BUYER REGISTRATION
    All potential buyers must pre-register PRIOR to bidding. North Star Horse Sale reserves the right to accept or reject any potential or registered bidders at their discretion, as they see fit, at any time.
  2.  BIDDING
    ALL BIDS ARE A BINDING CONTRACT. By placing a bid, you acknowledge that your bid is a legally binding offer to purchase the horse being auctioned. There are no canceled or retractable bids allowed for any reason. Attempting to do so or failure to pay the full winning bid amount will result in legal action. The Buyer is the highest bidder at the time of the lot closing. North Star Horse Sale does implement a “soft close”. If there is a bid within the last two minutes of the lot closing, the timer will reset for an additional two minutes. This process will be repeated until there is a bid that stands as the highest bid for 2 minutes. The placer of that bid will be deemed the Buyer. If there is a dispute between bidders, North Star Horse Sale will settle said dispute as they see fit and that decision will be final.  
  3.  BUYER’S PREMIUM

    There is no buyer’s premium of any kind on any horse purchased through North Star Horse Sale.

  4. ACCEPTABLE FORMS OF PAYMENT
    All payments must be made directly and completely to North Star Horse Sale within 24 hours of the auction closing. Payment must be confirmed and cleared prior to transportation or pick-up. Non-US Bidders are welcome. Please note all bids are USD. The following methods of payment are accepted:
     1. US Bank Wire Transfer (RECOMMENDED)
     2. Overnighted US Cashier’s Check OR Money Order (tracking must be provided)
     3. Cash
     4. Mastercard, Visa, Discover, & American Express

    A CONVENIENCE FEE OF 4% WILL BE ADDED TO ALL CREDIT CARD TRANSACTIONS.

  5. BIDDER'S AND BUYER'S RESPONSIBILITIES
    Buyers have the right and responsibility to personally and/or professionally examine any horse offered through North Star Horse Sale PRIOR to bidding or buying. Veterinary pre-purchase exams are welcome and are the sole responsibility of the bidder/buyer. Any buyer who fails to personally or professionally examine any horse offered through North Star Horse Sale does so at their own risk. Potential buyers do have the option to go and test ride any horse offered by North Star Horse Sale, BEFORE they bid and BEFORE the auction closes. Once teh auction has closed, the horse is sold and you will not be allowed to ride the home on the North Star property.


  6. WARRANTIES
    All horses sold through North Star Horse Sale are sold with no expressed or implied warranties of any kind. This includes, but is not limited to; soundness, condition, merchantability, or fitness for any particular purpose of any horse offered for sale. All horses sold through North Star Horse Sale are sold "As Is" with any existing conditions and/or defects. All sales are final.


  7. TRANSPORTATION
    Upon authorization of North Star Horse Sale, the Buyer or the Buyer's designated transporter may pick up the horse. The Buyer is responsible for having the horse removed within seven (7) days. After seven (7) days, the Buyer is responsible for board a the rate of $20 per day, per horse. North Star Horse Sale can assist in making transportation arrangements within the continental US if needed.

  8. TITLES AND RISKS
    The title of the horse transfers immediately upon the Buyer's placement of the winning bid. At that time, all risk and responsibilities of the horse become that of the Buyer. This includes all risk of loss including, but not limited to; illness, injury or death of the horse. The Buyer agrees to hold North Star Horse Sale harmless for any loss or damage.

  9. DEFAULT
    All Buyers will be responsible for the full purchase price for the horse as described above. Any Buyer who fails in any respect to make full and complete payment within 24 hours will be declared in default. Any horse purchased by a defaulter may be resold by North Star Horse Sale by public or private sale without notice to the defaulter. In the case that the resale amount is less than the defaulter's debt to North Star Horse Sale, the defaulter will be responsible for any remaining balance in addition to any cost of resale. North Star Horse Sale may take legal action against the defaulter if they fail to satisfy these debts. In addition to what is described above, the defaulter will also be responsible for all attorney fees incurred by North Star Horse Sale.

  10. TRANSFERS/REGISTRATION CERTIFICATES
    Buyers will not receive any registration certificates until payment is received and cleared. No exceptions.

    By registering and bidding you are acknowledging that you are in agreement with all terms and conditions.
